Registration with and use of the Website for Candidates is free. We will process your personal data on the basis set out below as it is in our legitimate interests to do so following your registration.

What Information do we collect about you?

We collect personal data about you when you register with the Website. We do so in order to provide you with the recruitment services that are available through the Website as well as for administrative purposes, such as a billing address.

The personal data that we collect includes your name, email address and telephone number. If you are a Candidate, we will also ask for details of the kind of work you are looking for and your preferred work location. If you are required to upload a CV, cover letter, personal statement or other similar document or information we will keep that information for as long you want to keep your account with the Website.

What do we do with your personal data?

By registering with the Website, it is understood that work seekers are actively soliciting contact from prospective Employers about opportunities which match the Candidates’ fields of interest. If you are a Candidate, we will therefore make your personal data available to Employers who use the Website to find suitable Candidates for specific roles that they are seeking to fill.

We will not share your personal data, with any 3rd party unless your express agreement has been received or we are legally required to do so.

Although the primary purpose of the Website is to allow Candidates and prospective Employers to find each other, both Candidates and Employers have the ability to control the extent to which their personal data is shared with prospective Candidates and Employers through the manage preferences section of their account

For Candidates, we will use your personal data to provide you with the recruitment services that we provide, to manage your account and to email/notify you about recruitment services which include job alerts and emails relevant to your fields of interest.

For Employers, we will use your personal data to provide you with the recruitment services that we provide, to manage your account and to email/notify you about recruitment services which include candidate details (only once they have provided permission) relevant to your vacancy.

Marketing

In the event that you register on the Website as a Candidate we will only send you information which relates to our recruitment services unless you specifically opt in to receiving other material.

If you consent to receive marketing material using your contact preferences, you may change your mind at any time.

You can also amend the contact preferences in your account to stop us from contacting you in connection with the recruitment services through the Website for which you register when you set up your account.

Your Legal Rights

You have the right to:

Make a Data Subject Access Request to access your Personal Information at any time. This enables you to receive a copy of the Personal Information we hold about you and to check that we are lawfully processing it.

Request correction of the Personal Information that we hold about you. This enables you to have any incomplete or inaccurate Personal Information we hold about you corrected, although we may need to verify the accuracy of the new data you provide to us.

Request erasure / deletion / removal of your Personal Information. This enables you to ask us to delete or remove your Personal Information where we do not have a valid reason to continue to process it. You also have the right to ask us to delete or remove your Personal Information where you have successfully exercised your right to object to processing, where we may have processed your information unlawfully or where we are required to erase your Personal Information to comply with local law. Please Note: we may not always be able to comply with your request for erasure for specific legal reasons which will be notified to you, if applicable, at the time of your request.

Object to processing of your Personal Information where we are relying on a legitimate interest (or those of a 3rd party) and there is something about your situation which makes you want to object to processing on this ground as you feel it impacts on your fundamental rights and freedoms. You also have the right to object where we are processing your Personal Information for direct marketing purposes. In some cases, we may demonstrate that we have compelling legitimate grounds to process your information which override your rights and freedoms.

Request restriction of processing of your Personal Information. This enables you to ask us to suspend the processing of your Personal Information in the following scenarios: (a) if you want us to establish the data’s accuracy; (b) where our use of the data is unlawful but you do not want us to erase it; (c) where you need us to hold the data even if we no longer require it as you need it to establish, exercise or defend legal claims; or (d) you have objected to our use of your data but we need to verify whether we have overriding legitimate grounds to process it.

Data Portability / Request the transfer of your Personal Information to you or directly to another controller. This right only applies to automated information which you initially provided consent for us to use or where we used the Personal Information to perform a contract with you.  We will (unless there is an exemption) assist you by securely transferring your Personal Information directly to another controller where technically feasible or by providing you with a copy in a structured commonly used machine-readable format.

Withdraw consent at any time where we are relying on your consent to process your Personal Information. However, this will not affect the lawfulness of any processing carried out before you withdraw your consent. If you withdraw your consent, we may not be able to provide certain services to you. We will advise you if this is the case at the time you withdraw your consent.

We want to ensure we keep your Personal Information accurate and up to date.  In addition to your legal rights, you may ask us to make changes or request a copy of your Personal Information informally, by contacting Simon Bailey Associates and requesting it.

Additional information, Response Times and Fees

We may need to request specific information from you to help us confirm your identity and ensure your right to access your Personal Information (or to exercise any of your other rights or when you make an informal request). This is a security measure to ensure that Personal Information is not disclosed to any person other than the individual who has the right to receive it. We may also contact you to ask you for further information in relation to your request to help us locate your data and to speed up our response.

We try to respond to all legitimate requests within one month. It may take us longer than a month if your request is particularly complex or you have made several requests. In this case, we will notify you and keep you updated.

You will not have to pay a fee to exercise any of these rights. However, we may charge a reasonable fee if your request is unfounded, repetitive or excessive. Alternatively, we may refuse to comply with your request in these circumstances.
